Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.)

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day,

  • on which you or a third party named by you who is not the carrier took possession of the goods, provided you have ordered one or more goods in a single order and these are delivered uniformly;
  • on which you or a third party named by you who is not the carrier took possession of the last goods, provided you ordered several goods in a single order and these are delivered separately;
  • on which you or a third party named by you who is not the carrier took possession of the last partial shipment or the last piece, provided you ordered a good that is delivered in multiple shipments or pieces;

To exercise your right of withdrawal, you must inform us (HOT Productions & Vertriebs GmbH, Wagrainer Straße 35, 4840 Vöcklabruck, Telephone No.: +43 7672 72 009, Email Address: office@hot-dl.com) by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You can use the attached model withdrawal form for this, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication regarding your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments we have received from you, including delivery costs (except for the additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within 14 days from the day on which we receive notification of your withdrawal from this contract.

We will make this reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no case will you incur any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us or HOT Productions & Vertriebs GmbH, Wagrainer Straße 35, 4840 Vöcklabruck without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion or Early Expiry of the Right of Withdrawal

The right of withdrawal does not exist for contracts

  • for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;
  • for the delivery of goods that can spoil quickly or whose expiration date would quickly be exceeded;

The right of withdrawal expires early for contracts

  • for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery;
  • for the delivery of goods if they were inseparably mixed with other goods after delivery due to their nature;
